Section 35-b of the
Judiciary Law sets forth the procedures for obtaining legal representation
in capital cases. If a trial judge determines a defendant is unable
to afford counsel, two qualified attorneys can be appointed to represent
the defendant. These attorneys, called 35-b attorneys after the Judiciary
Law, must meet standards set by the New York Court of Appeals.
